He saw no point in carrying on with a case which would cost the club a considerable amount of money with no real prospect of winning the trial.
"I am aware that this decision may come as a profound disappointment to the directors and the club's supporters, but a decision of this kind can benefit not just a winning party but a losing party." Saffman said.
"It is far better to learn at an early stage before costs of hundreds of thousands of pounds are incurred. The sense of disappointment would be considerably greater if this case went to a further hearing and defeat for the claimant (Rotherham United) resulted in costs being significantly greater than they are now." he added.
In striking the case out, he awarded the Booths £65,000 costs with £25k of that to be paid within 14days, the Millers barrister Hugo Groves called the amount of costs over the top.
