Millers give statement on court case defeat..

Although the judge has decided in favour of C F Booth over whether we can go forward with a case over turning the onerous lease the club inherited, it is by no means the end of the world.The judge actually supported the club's views on many points and his final decision was based on a technicality.The judge was concerned over a piece of untested law that came to the forefront, "Could the present club be both victim and claimant?". The judge feared that to give this a full airing could prove to be a costly route and was not in the club's interest.
One must remember that this fight was instigated by C F Booth's taking court action after one month's rent was paid late.The fact is that the club is thinking of its long term position and will continue to pursue any action that furthers its cause.The club has continued to pay the rent every month and will continue to do so as the tenant of C F Booth's, albeit at a slightly higher rent as they took the initiative to increase this during the last few months, as allowed by the lease.It is no threat and we will continue to pay them their dues accordingly.
The season has just started and there is a lot of work to do on the football field.The directors will, in a few weeks time, meet to take stock.There has always been a "Plan B" although the directors' view is that it was less savoury and involves Mr Booth Senior over his conduct as a director, working in the club's interest.There is a great overlap in the legal work already done, which makes this a lot easier than starting afresh.
The mathematics over what happened when the club's assets were removed do not add up and this issue will not go away, so undoubtedly we will all be talking again but including Ken Booth Senior this time.Some good has come out of this in the form of an option that was not available before but which may now prove a very useful alternative strategy for the board's consideration and club's future.
